TERMS AND CONDITIONS
PRIVACY INFORMATION
- It is in APCOA’s legitimate interests to accept bookings for use of the Car Park as well as to regulate parking by those using the car park in accordance with such a booking. Also, you enter into a contract every time you book to use the car park as well as every time you make use of it. This includes your agreement to your information being processed as part of the contracts you make to use the car park.
- On entry to and while you are using the car park APCOA collects and processes certain data to make sure that the booking made by you and the conditions that apply to your booking (which include the terms set out above and those displayed at the car park are complied with and to enforce these where necessary. This may include obtaining the registered keeper’s name and address from the DVLA in order to send a Notice to Keeper, any related correspondence and any further notices if a Parking Charge becomes payable and/or remains unpaid.
- APCOA will also use the data it collects for car park management such as reporting on vehicle turnover and repeat visits in order to improve the customer experience. The data we collect may include images of vehicles using the car park and/or their vehicle registration mark. This can be collected via ANPR cameras and/or attendants on site as well as via payment machines or terminals.
- APCOA may share data from time to time as required to support the purposes stated above and may pass data to the police if we have reason to think that a crime may have taken place. If relevant and appropriate, APCOA may also, from time to time, share the data it has collected with a client who has appointed it to manage the Car Park.

1. Introduction |
These are the Terms and Conditions upon which we accept Bookings on line or by telephone to park at our Car Parks. It is important that you read them and understand them before completing your Booking. |

Our Conditions of Parking also apply and form part of the same contract that is created by a Booking. These are set out below. Again, please read them and understand them before completing your Booking. |
|
When reading these Booking and Payment Terms, the following words or phrases have the following meanings: |
Booking Period means the period commencing with the date that you specify as your date of entry to the Car Park, and ending on the date that you specify for leaving it. |
Car Parks means the car parks controlled by us and Car Park shall be interpreted accordingly. |
Conditions of Parking means the conditions of parking published on our website and displayed at the entrance to our Car Parks. |
Tariff Board means any board or notice at a Car Park displaying the charges to be paid for parking. |
Booking means any booking for the parking of a Vehicle at a Car Park. |
Booking and Payment Terms means these Booking and Payment Terms. |
Permissible Amendments means only amendments to: |
Vehicle means any Vehicle which is parked in a Car Park and includes any mechanical device on wheels or tracks, its equipment and accessories. |
We, us, our means Apcoa Parking (UK) Limited. |
You, your means any person who makes a Booking or (where the context allows) uses a Car Park for the parking of a Vehicle. |

These Booking and Payment Terms and any Booking resulting from them are subject to English law. |

2. The Agreement between you and us |
|
2.1 These Booking and Payment Terms apply to your Booking. So do the Conditions of Parking. |
|
2.2 We follow & stand by both the Booking and Payment Terms and the Conditions of Parking. If there is anything you do not understand or do not agree with, please discuss this with us before making your Booking |
|
2.3 Our employees or authorised agents are not permitted to make any representations unless these are confirmed in writing. If we agree changes, please ask us to confirm them in writing. |
|
2.4 Nothing in these Booking and Payment Terms or the Conditions of Parking affects your statutory rights. |
|
2.5 If you book online at https://portsmouth.apcoa.co.uk, a binding agreement will exist between you and us after you have transmitted a completed booking form to us via the online booking system, and we have sent an e-mail acknowledgement to you in accordance with condition 3 below |
|
2.6 If you book over the telephone, a binding agreement will exist between you and us when our telephone sales person gives you your Booking reference, in accordance with condition 4 below. |

3. How to Book Online |
|
3.1 If you wish to park your Vehicle in our Car Park and wish to book online, please complete the booking process at https://portsmouth.apcoa.co.uk in which you will submit your Booking request to us. |
|
3.2 Once we have received your completed booking form through the process outlined in condition 3.1, we will send an e-mail to you at the e-mail address you have provided on the booking form. That e-mail will include a Booking reference which you need to quote if you would like to contact us about your Booking. |
|
3.3 The Booking will be completed when we send that e-mail. In the event that you cannot provide an e-mail address for this purpose, we will post the confirmation to you at the postal address you provide on the booking form. The Booking is completed when we post that confirmation to you. |
|
3.4 Please check immediately that the information contained in the Booking confirmation email or letter is correct and let us know if it is not. Our contact details are set out below in condition 13. |

3.5 The Booking is personal to the person making it and cannot be transferred to any other person. |
|
4. How to Book over the Telephone |
|
4.1 If you wish to park your Vehicle in one of our Car Parks and would like to book by telephone, please call us on 0239 287 3378. (Calls from UK BT land lines will cost no more than 10 pence per minute. Calls from mobiles and other networks may vary and may be higher). |
|
4.2 Our telesales staff will complete your booking form by taking the relevant details from you. On completion of the Booking, you will be given a Booking reference which you will need to quote if you would like to contact us about your Booking. |
|
4.3 The Booking will be completed when we provide you with your Booking reference. If you provide us with an e-mail address, we will e-mail a confirmation of your Booking to you. In all other cases, we will post the confirmation to you at the postal address you provide the telesales staff with when completing the booking form on your behalf. |
|
4.4 Please check immediately that the information contained in the Booking confirmation e-mail or letter is correct and let us know immediately if it is not. Our contact details are set out below in condition 13. |
|
4.5 The Booking is personal to the person making it and cannot be transferred to any other person. |
|
5. Change to the Booking Period |
|
No refund will be made if your stay is shorter than the Booking Period. If you arrive early or leave late, meaning your Vehicle is parked in a Car Park on days or time outside the Booking Period, you will be charged for those extra days/time at the rate specified on the Tariff Board applicable to the Car Park. This will be the case even if your total stay is no longer than the Booking Period. Please note that the rate that you are charged for this extra stay will be the rate that would have been charged had you not pre-booked. |

6. Booking Disabled Spaces |
|
Our Car Parks have disabled spaces for use by blue badge holders, but unfortunately we cannot accept bookings specifically for disabled spaces. If you have any particular requirements, please contact a member of APCOA staff on arrival. Should you need any further help or assistance then please call the helpline number on the Terms & Conditions board at the Portsmouth Port Car Park. |

7. Cancelling a Booking * |
|
7.1 You are able to cancel your booking and receive a full refund providing you notify us of the cancellation by midday on the date of arrival specified on the Booking. Cancellations made after this time will not be refunded. |
|
7.2 a) Cancellation or Amendment on line |
You can cancel or amend your Booking online at https://portsmouth.apcoa.co.uk by selecting ‘Manage my booking’. |
|
7.2 b) Cancellation or Amendment by telephone |
You can cancel or amend your Booking by calling us on the following telephone number: 0239 287 3378. |
|
7.2 c) Cancellation or Amendment by e-mail |
You can cancel or amend your Booking by e-mail to admin.portsmouth@apcoa.com. |
|
* We recommend that you cancel or amend your Booking online or by telephone. You can write to us, although your cancellation will not take effect until we receive your letter. Proof of posting is not sufficient to cancel your booking. We recommend postal cancellations are followed by a telephone call to confirm your cancellation has been received. |
|
7.3 You will be charged in full for your Booking if you leave the Car Park before the end of the Booking Period. |
|
8. Prices and How to Pay |
|
8.1 The price that you are quoted includes VAT and is fixed when you make your Booking. |
|
8.2 You can pay for your Booking by using any of the credit or debit cards that we accept. Details are shown on the booking form you will complete when making your booking online at https://portsmouth.apcoa.co.uk. If booking by telephone, the telesales staff will present the payment card options to you. We may charge for the use of credit or debit cards, and the charge may vary according to which card you use. We do not accept payment by cash or cheque. |

9. What to do on Arrival |
|
We do not issue tickets for pre-paid Bookings. The arrival procedures will vary by car park. Please refer to the details provided on your booking confirmation. |
|
10. Vehicles Permitted in our Car Parks |
|
10.1 We only accept Bookings for cars and light vans. You are not entitled to a refund if your Vehicle exceeds the size limits we impose. Please contact us (contact details are set out in condition 13) if you would like to check whether your Vehicle will be accepted. |
|
10.2 When you book you may be required to specify the registration number of the Vehicle to which the Booking relates. You may change these details at any time before you arrive at the Car Park, at no charge, by contacting us. Our contact details are set out below in condition 13. |
|
11. Our Responsibility to You |
|
11.1 Once you have booked and we have received payment for that Booking, you are entitled to park the designated Vehicle in your selected Car Park on the date(s) specified in your Booking. Parking of your Vehicle will be subject to the Conditions of Parking. |
|
11.2 On very rare occasions, we may not be able to accommodate your Vehicle. If this happens, we will do our utmost to let you know as soon as possible in advance and will try and make alternative arrangements for you. We will do this at our cost. A full refund will also be provided. This summarises the full extent of our liability to you. |
|
11.3 We will only use your information for the purpose of processing your booking and payment. We will not disclose your information to anyone outside APCOA, except where we are required or permitted to do so by law. |
|
12. Comments and Complaints |
|
12.1 We request that all comments relating to the Booking procedure and experience are made in writing to us at the address set out in condition 13. |
|
12.2 We aim to answer all complaints within 5 working days. If this is not possible, we will tell you when we expect to be able to respond. |
